1. Acceptance of Terms
These Terms of Use ("Terms") constitute a legally binding agreement between you and SAFER Technologies UG (haftungsbeschränkt) ("SAFER Technologies", "we", "us", "our"), governing your access to and use of the FLARE mobile application and related services (collectively, the "Service").
By downloading, installing, or using FLARE, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 13 years old to use FLARE. By using the Service, you represent and warrant that you meet this age requirement.
If you are between 13 and 16 years old (or the applicable age of digital consent in your country), you represent that your parent or legal guardian has reviewed and consented to these Terms and your use of the Service.
FLARE is not directed at children under the age of 13. If we become aware that a user is under 13, we will immediately terminate their account and delete all associated data.
3. Your Account
3.1 Registration
To access most features of FLARE, you must create an account by providing a username, email address, and password. You agree to provide accurate and complete information and to keep it up to date.
3.2 Account Security
You are responsible for maintaining the confidentiality of your password and for all activities that occur under your account. Notify us immediately at flare@safer.network if you suspect unauthorized access.
3.3 One Account per Person
Each user may register one account. Creating multiple accounts to circumvent suspensions, bans, or voting restrictions is prohibited and will result in all accounts being terminated.
3.4 Account Deletion
You may delete your account at any time via Profile → Settings → Delete Account, or by emailing flare@safer.network. See our Support page for instructions.
4. User-Generated Content
4.1 Your Content
"User Content" means any photos, profile information, display names, or other material you submit to FLARE. You retain ownership of your User Content.
4.2 License to Us
By submitting User Content, you grant SAFER Technologies a worldwide, non-exclusive, royalty-free, sublicensable license to store, display, distribute, and use your content within the FLARE Service (e.g., showing your photos in battles and on leaderboards). This license ends when you delete the content or your account.
4.3 Content Standards
You agree that your User Content will not:
- Be illegal, defamatory, obscene, or infringe any third-party rights
- Contain nudity, sexually explicit material, or graphic violence
- Depict or glorify self-harm, suicide, eating disorders, or dangerous activities
- Constitute hate speech targeting individuals or groups based on protected characteristics
- Include personal information of others without their consent
- Be spam, artificially manipulated, or submitted via automated means
- Violate any applicable laws or regulations
4.4 Moderation
We use automated and manual moderation to enforce these standards. We reserve the right to remove any User Content that violates these Terms without prior notice. Repeated violations will result in account suspension or termination.
To report content: Tap the ⋯ menu on any photo and select "Report", or email flare@safer.network.
5. Prohibited Conduct
When using FLARE, you agree not to:
- Manipulate votes — Use bots, scripts, vote rings, or any coordinated means to artificially inflate Flare counts
- Impersonate others — Create accounts designed to impersonate another person or entity
- Reverse engineer — Attempt to decompile, disassemble, or extract source code from the app
- Interfere with the Service — Attempt to disable, overload, or disrupt the FLARE servers or infrastructure
- Scrape data — Use automated tools to collect data from FLARE without written permission
- Circumvent safety measures — Attempt to bypass content moderation, account restrictions, or geographic limits
- Harass users — Use FLARE to bully, harass, or stalk other users
- Violate laws — Use FLARE for any illegal purpose under applicable law
6. Premium & In-App Purchases
6.1 Premium Subscription
FLARE offers an optional Premium subscription that removes ads and unlocks additional features. Subscriptions are billed through the Apple App Store or Google Play on a recurring basis (monthly or annual, as selected).
6.2 Billing & Renewal
Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. Your Apple ID or Google account will be charged for renewal within 24 hours prior to the end of the current period.
6.3 Cancellation
You may cancel your subscription at any time through your App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period — you retain Premium access until then. We do not offer refunds for partial billing periods.
6.4 Refunds
All purchases are processed by Apple or Google. Refund requests must be submitted directly to Apple (reportaproblem.apple.com) or Google Play. We do not process refunds directly.
⚠️ If you delete your FLARE account, you will lose access to Premium features. Cancel your subscription through the App Store before deleting your account to avoid further charges.
7. Advertising
The free version of FLARE is supported by advertising served via Google AdMob. By using the free version, you agree to the display of advertisements. You may remove ads by purchasing a Premium subscription.
On iOS, we will request your consent via Apple's App Tracking Transparency framework before using your Advertising Identifier for personalized ads. You may change this at any time in iOS Settings. See our Privacy Policy for full details.
8. Intellectual Property
8.1 SAFER Technologies IP
The FLARE app, including its name, logo, design, code, features, and all content created by SAFER Technologies, is owned by SAFER Technologies UG (haftungsbeschränkt) and protected by intellectual property laws. Nothing in these Terms grants you any rights to our intellectual property.
8.2 Feedback
If you submit feedback, suggestions, or ideas about FLARE, you grant us the right to use that feedback without any obligation to compensate you.
8.3 Third-Party Content
FLARE may display content from other users. We do not claim ownership of such content and are not responsible for it. If you believe your copyrighted work has been infringed, contact us at flare@safer.network.
9. Termination
We reserve the right to suspend or terminate your account at any time, with or without notice, if we determine that you have violated these Terms, applicable law, or if we believe your actions may harm other users or the integrity of the Service.
Upon termination, your right to use FLARE ceases immediately. Provisions of these Terms that by their nature should survive termination (including Sections 4, 8, 10, 11, and 12) shall continue to apply.
10. Disclaimer of Warranties
FLARE is provided "as is" and "as available" without warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, SAFER Technologies disclaims all implied warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that FLARE will be uninterrupted, error-free, or free of viruses or other harmful components. We do not guarantee the accuracy, completeness, or reliability of any user-generated content on the platform.
11. Limitation of Liability
To the maximum extent permitted by applicable law, SAFER Technologies and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of FLARE.
Our total liability to you for any claims arising from your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim (or €50, whichever is greater).
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under applicable German law.
12. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions.
Any disputes arising from these Terms or your use of FLARE shall be subject to the exclusive jurisdiction of the courts of Mannheim, Germany, unless mandatory consumer protection law in your country of residence requires otherwise.
If you are a consumer in the EU, you may also have access to the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr. We are not obligated to participate in ODR procedures but will consider them case by case.
13. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by displaying a notice in the app or via email at least 14 days before the changes take effect. Your continued use of FLARE after the effective date constitutes acceptance of the revised Terms.
